These Terms of Service (“Terms”) govern your access to and use of getyoniq.com (the “Site”) and any products, content, features, tools, and services offered by Yoniq, operated by Kanopy Group LLC (“Yoniq,” “we,” “us,” or “our”).

By visiting the Site, placing an order, purchasing a product, contacting us, or otherwise using our services, you agree to be bound by these Terms, together with our Privacy Policy, Return Policy, Shipping Policy, and any other policies referenced on the Site.

If you do not agree to these Terms, you should not access the Site, use our services, or purchase products from us.

Yoniq is an ecommerce brand offering physical personal care products, including pelvic wellness products, intimate care devices, and related accessories. We do not offer digital downloads. All products sold through the Site are physical goods unless expressly stated otherwise.

Yoniq is not responsible for injuries, damages, adverse effects, or losses resulting from improper use, failure to follow instructions, unauthorized modifications, use with incompatible products, use despite contraindications, or use in violation of these Terms.

10. Orders

When you place an order through the Site, you are making an offer to purchase the products in your cart under these Terms. We reserve the right to accept, reject, cancel, limit, or refuse any order for any reason, including suspected fraud, unauthorized activity, product unavailability, pricing errors, shipping restrictions, or violation of these Terms.

After placing an order, you may receive an order confirmation email. This confirmation does not guarantee acceptance of your order. An order is accepted when we process it and/or ship the product.

We may limit or cancel quantities purchased per person, per household, per order, per payment method, per billing address, per shipping address, or per customer account.

We do not store your full credit card number or payment security code. Payments are processed by third-party payment processors according to their own terms and privacy practices.

15. Shipping and Delivery

Shipping times displayed on the Site are estimates only. Actual delivery times may vary depending on product availability, processing time, destination, carrier delays, customs processing, holidays, weather, incorrect address information, and other factors outside our control.

Once an order has been processed, fulfilled, or handed over to a carrier or fulfillment partner, we may not be able to cancel, modify, reroute, or change the shipping address.

Delivery estimates are not guaranteed unless expressly stated. We are not liable for delays caused by carriers, customs, weather, holidays, incorrect addresses, failed delivery attempts, or events outside our reasonable control.

If your order is delayed, lost, marked as delivered but not received, or returned to sender, please contact us at support@getyoniq.com so we can assist you according to our shipping and support procedures.

16. Risk of Loss

Risk of loss and title for products purchased from us pass to you when the product is delivered to the carrier, unless otherwise required by applicable law.

If a package is marked delivered by the carrier but you cannot locate it, you should check with household members, neighbors, building staff, mailrooms, local postal services, or the carrier. We may assist with carrier claims where possible, but we cannot guarantee replacement or refund for packages marked delivered.

17. Returns, Refunds, and Exchanges

Returns, refunds, exchanges, cancellations, and related conditions are governed by our Return Policy.

Because we sell intimate wellness and personal care products, certain items may be non-returnable or subject to specific hygiene, safety, packaging, or condition requirements. Products that have been opened, used, damaged, altered, or removed from their original packaging may not be eligible for return unless required by law or expressly stated in our Return Policy.

Shipping fees, return shipping costs, customs fees, duties, taxes, and handling fees may be non-refundable unless otherwise required by law or expressly stated in our Return Policy.

The name Yoniq, our branding, product names, logos, slogans, and related marks may not be used without our prior written permission.

If you submit reviews, testimonials, photos, videos, comments, feedback, suggestions, ideas, proposals, survey responses, social media content, or other materials to us or about our products (“User Content”), you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable, transferable license to use, reproduce, publish, translate, edit, adapt, display, distribute, and create derivative works from that User Content in any media, including on the Site, in emails, advertisements, social media, product pages, and other marketing materials.

You represent and warrant that:

You own or have the necessary rights to submit the User Content;

Your User Content does not contain unlawful, abusive, obscene, defamatory, misleading, harmful, or malicious material;

We may, but are not obligated to, monitor, edit, remove, or refuse User Content at our discretion.

You agree that we have no obligation to keep User Content confidential, compensate you for User Content, publish User Content, or respond to User Content.

We reserve the right to contest chargebacks or payment disputes that we believe are improper, fraudulent, or inconsistent with our policies, shipping records, delivery confirmation, order records, or these Terms.

32. Disclaimer of Warranties

The Site, services, content, and products are provided on an “as is” and “as available” basis, except as expressly stated otherwise or required by law.

We do not guarantee, represent, or warrant that:

The Site will be uninterrupted, timely, secure, or error-free;
The Site will be free from viruses, malware, or harmful components;

35. Force Majeure

We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, severe weather, war, terrorism, civil unrest, labor disputes, supply chain disruptions, transportation delays, carrier delays, customs delays, government actions, pandemics, epidemics, power failures, internet outages, cyberattacks, payment processor issues, or other events outside our control.

The remaining provisions will remain valid and enforceable.

These Terms, together with our Privacy Policy, Return Policy, Shipping Policy, and any other policies or terms posted on the Site, constitute the entire agreement between you and us regarding your use of the Site and purchase of products.

These Terms supersede any prior or contemporaneous agreements, communications, proposals, or understandings between you and us, whether oral or written.

40. Governing Law

These Terms and any dispute arising from or relating to these Terms, the Site, services, or products shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to conflict of law principles.

Most concerns can be resolved quickly by contacting customer support. If we cannot resolve a dispute informally, any dispute will be handled in accordance with applicable law and the governing law stated in these Terms.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

42. Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent.

We may assign, transfer, or delegate these Terms or any rights or obligations under them in connection with a merger, acquisition, sale of assets, reorganization, financing, change of control, or by operation of law.
